For sellers

The House File.

Seven questions, and you know which documents your sale needs. Not ‘roughly these’, but a finite list, with the name, the Spanish term and the office that issues each one.

Afterwards you can print the sheet or save it as a PDF, put your folder beside it and tick things off. Whatever is missing, I will get for you.

Nothing is saved and nothing is sent. Your answers stay in this window and are gone the moment you close it. There is no sign-up, no cookie and nothing is passed on to me. At the end, you decide for yourself what you want to show me.

01What are you selling?

This matters more than anything else. A flat needs papers a finca has never heard of, and the other way round.

02Is there a community of owners?

Flats almost always have a comunidad de propietarios, and so do many terraced houses and developments with a shared pool or driveway.

03Has anything been built, extended or altered?

That means anything that changed the floor area or the layout: an extension, a pool, a covered terrace, a converted basement, a second bathroom. Even if it happened before your time.

04Is the property let?

Even if it is only let now and then, or the letting is currently paused.

05Are you tax resident in Spain?

As a rule, you are resident if you live in Spain for the greater part of the year. When a non-resident sells, the buyer withholds part of the purchase price and pays it to the tax office; that is not an additional tax but a payment on account.

06Is there a mortgage or any other charge on it?

Besides a mortgage, there can also be attachment orders, a usufruct or rights of way. The Nota simple shows them, which is why ‘I don’t know’ is a good answer here.

07Who is on the Land Registry?

All registered owners must attend the notary appointment or be validly represented.

Nothing is sent. The list is built in your browser.
